Pursuant to Art. 13 sec. 1 and sec. 2 Regulation of the European Parliament i  Of the Council (EU) 2016/679 z  on April 27, 2016  on the protection of natural persons in  connection with  processing of personal data i  on the free movement of such data and repealing Directive 95/46 / EC (General Regulation  data protection), hereinafter referred to as the Regulation, we would like to inform you that for the purposes of the operation of our website – www.amy.com.pl  (hereinafter referred to as the Website or the Online Store), we process your personal data in accordance with the information provided below.

The Privacy Policy is a set of rules aimed at informing Website Users about all aspects of obtaining, processing and protecting personal data, provided while visiting the Website. Each User using the Website hereby accepts the following Privacy Policy.

The administrator of your personal data is AMY, hereinafter referred to as the Administrator.

We process personal data on the basis of art. 6 sec. 1 point a, b, c, e, f of the Regulation, as well as art. 18 of the Act of July 18, 2002. on the provision of electronic services.

What data do we collect about you?

Data collected during registration

Before we can make a purchase transaction in our store, we will ask you for your name, surname, address, telephone number and payment method data, e.g. credit card type, credit card number, expiry date, CVV number.

PW if you provide your personal data in order to conclude a contract with the Online Store, providing your personal data is a condition for the conclusion of this Agreement. Providing personal data in this situation is voluntary, but the consequence of not providing this data will be the inability to conclude a contract with the Online Store.

Data collected automatically

You can visit our website without providing any personal data. Each time the website is accessed, the server automatically saves only the so-called server logs, such as the name of the requested file, your IP address, the date and time of the call, the amount of data transferred and the Internet service provider submitting the request (access data) and documents the page call.

These data are analyzed solely for the purpose of ensuring the proper functioning of the website and improving our offer. The above serves – as part of the assessment of interests – to secure our legitimate interest, consisting in the correct presentation of our offer.

Data collected when you contact us

When you contact us via the website, telephone, e-mail, etc., you provide us with your personal data, e.g. name, surname, e-mail address, etc.

How do we use your data?

Personal data is processed on the basis of the consent expressed by the User and in cases where the law authorizes the Administrator to process personal data on the basis of legal provisions or to implement the contract concluded between the parties.

The data provided in the form are processed for the purpose resulting from the function of a specific form, e.g. to process the information contact.

The data collected during registration will be used only to enable you to log into our system and the data provided by you during shopping will be processed only in  for the purpose of issuing an invoice or bill.

The data collected during the purchase transaction will be used to complete the transaction, including collecting money from you and sending you the ordered goods.

Data collected automatically can be used to analyze user behavior on our website, collect demographic data about our users or to personalize the content of our websites. These data are collected automatically about each user, if you consent to our use of cookies.

The data collected during the correspondence between you and our website will be used only to answer your inquiry.

Time of processing your personal data

Your data will be processed only for the duration of the sale contract and until the claims of the parties related to the contract or provision of services are time-barred, in particular the period required by accounting and tax regulations, the period of existence of any rights under the warranty and guarantee, but no longer than for 5 years counted from the end of the calendar year in which the tax obligation under the contract arose.

Provision of personal data

Office and institutions .  In the event of an inspection by the Office for Personal Data Protection, your data may be made available to employees of the Office in accordance with applicable law. Similarly, if you request us to disclose your personal data by another authority authorized in accordance with the provisions of law, your data may be transferred for the purposes of the pending proceedings.

In the event of a breach of the Regulations of our website, violation of the law or when required by law, we may disclose your data to the judicial authorities.

Hosting services.  As part of entrusting data processing – on our behalf, an external service provider provides us with services in the field of hosting and presentation of websites. All data that – as described in this privacy policy – have been collected as part of the use of our website or in the forms provided for this purpose in the online store, are stored on the servers of this service provider. Processing on other servers takes place only to the extent specified in this privacy policy.

This service provider is based in a country belonging to the European Union or the European Economic Area.

Shipping services.  In order to ship your order, we pass on your address details and e-mail address to the courier for the delivery of your order and, if you have given your consent, the telephone number to facilitate the contact and delivery of your order by the courier company.

Accounting and legal services . If it is necessary in connection with the fulfillment of our legal obligations, your personal data may be transferred to our subcontractors providing accounting and legal services in order to properly fulfill our obligations or defend our legitimate interests.

Payment services.  Depending on which payment service provider you choose during the ordering process, we transfer the payment data collected for this purpose to the credit institution that processes the payment and, if applicable, to the payment service provider selected by us or by you. Some payment service providers collect data themselves if you create an account with them. In such cases, you must log in to the payment service provider with your access data when ordering. The privacy policy of the respective payment service provider also applies.

Among other things, in connection with the above, AMY processes your personal data for the following purposes:

  1. transfer of your personal data to ING Bank Śląski SA (“Bank”) in connection with:
    • provision by the Bank to the Online Store of the service of providing infrastructure for handling payments via the Internet (legal basis: art
    • service and settlement by the Bank of payments made by customers of the Online Store via the Internet using payment instruments (legal basis: Article 6 (1) (f) of the Regulation).
    • in order to verify by the Bank the proper performance of contracts concluded with the Online Store, in particular to ensure the protection of payers’ interests in connection with their complaints (legal basis: Article 6 (1) (f) of the Regulation).
  2. transfer of your personal data to Twisto Polska sp. z o. o. due to the possibility of offering payment for the purchased goods or service by Twisto Polska sp. z o. o. under a contract of mandate covering the “Buy with Twisto” purchasing formula and making this purchasing formula available through the Online Store, as well as for verification by Twisto Polska Sp. z o. o  proper performance of such contracts – mandate (legal basis: Article 6 (1) (f) of the Regulation

If you provide your personal data for the purpose of transferring your personal data to Twisto Polska sp. z o. o. before concluding a contract for the sale of goods (or services) purchased in the Online Store, the provision of this data is a condition for the conclusion of a sales contract in connection with the business model adopted by the Online Store.

If you provide your personal data to the Bank in connection with the handling and settlement of payments made by you payments to the Online Store via the Internet using payment instruments, the provision of data is required in order to make the payment and provide confirmation of its payment by the Bank on Online Store item.

If your personal data is transferred to the Bank for the purpose of verification by the Bank of the proper performance of contracts concluded with the Online Store, in particular to ensure the protection of the interests of payers in connection with their complaints, providing this data is required to enable the implementation of the contract concluded between the Online Store and the Bank.

If your personal data is transferred to Twisto Polska sp. z o. o. in connection with the possibility of offering you the payment of the price for the goods or services purchased by you by Twisto Polska sp. z o. o. under the contract of mandate including the “Buy with Twisto” purchasing formula and making this formula available by the Online Store, providing this data and processing it for this purpose is required in connection with the business model of running the business adopted by the Online Store and in order to implement the contract concluded between the Store internet and Twisto Polska Sp. z o. o

If you have made a purchase of goods, you can receive emails from us regarding your transaction. We can also contact you by phone if we have important information regarding your transaction.

What are your rights in relation to the protection of your personal data? How can you inform us about the change of data?

In connection with the processing of your personal data, subject to the information indicated below, you are entitled to:

  1. the right to access your personal data,
  2. the right to rectify them if they are inconsistent with the actual state,
  3. the right to remove them or limit data processing,
  4. the right to object to the processing of personal data,
  5. the right to data portability.

The administrator provides the ability to view, correct and rectify the processed personal data. The user may at any time use the request from the Administrator to access the processed personal data, correct them, transfer personal data to another administrator and, if the processing of personal data is based on the consent granted, the right to limit the processing or delete personal data.

After logging in to the system and selecting the My Account section, you can make changes or delete your personal data collected during registration and used to log into the system. The data used for the purchase transaction cannot be changed or deleted, as they are part of the bill or invoice. These data will be deleted by us after the expiry of the limitation period for claims and after the expiry of the deadlines specified in the relevant legal provisions regulating the obligations of keeping accounting records.

Right to object

If we process personal data in the manner described in this privacy policy – as part of the analysis and assessment of interests – to protect our legitimate interests, you may object to such data processing for this purpose – with effect for the future. How do we secure your personal data?

We undertake to maintain secrecy related to personal data and to respect them properly. Personal data left on the website will not be sold or made available to third parties, in accordance with the provisions of the Act on the Protection of Personal Data and the Regulation.

    1. Cookies used by the Administrator are safe for the User’s Device. In particular, it is not possible for viruses or other unwanted software or malware to enter Users’ Devices this way.
